Terms *

This contract confirms the terms of agreement and services. All terms are final and not subject to negotiation. The terms of this agreement are subject to revision or amendment at any time by Life in Motion Photography. Please note that the terms of this agreement are binding on both parties. Life in Motion Photography shall provide services to photograph you and your family to the best of the photographer’s ability. Any artistic interpretations by the photographer will be deemed acceptable, agreeable and pursuant to the creative control of the photographer. The photographer reserves the right to terminate this agreement at any time for any reason and will provide verbal or written notice to you and your family within a reasonable amount of time prior to the photo session. The photographer will not be liable for termination of this contract. Reasons for termination may include but are not limited to; illness, traffic conditions, acts of nature, and family occurrence. Life in Motion Photography will not be held responsible or liable for the failure to obtain certain images if the management or owner of a location during any portion of the photo session requires the parties to leave the premises. Life in Motion Photography will make every reasonable attempt to capture the client’s desires to the best of the photographer’s ability and within the confines provided by the locations chosen. Life in Motion Photography will not be responsible or liable if specific shots, poses or angles are not captured. Failure to capture specified shots, poses or angles will not result in partial or full refund. Signature sessions generally last anywhere between 1-2 hours depending on the nature and location of the session. Mini sessions typically last 30 minutes. The photographer, at her discretion, may end a session if she has captured an adequate quantity and quality of images.

Retainer, Payment & Pricing *

FULL "SIGNATURE" SESSIONS: The client shall remit a $300 session fee to reserve the date of services for the portrait session. The session fee includes photographer time and talent only. Images must be purchased separately as part of a package. Your balance of $800 for the full digital download will be invoiced prior to the release of your gallery. A la carte prints are not available but photographer will recommend the best place to print your photographs. Life in Motion will present an average of 50 proofs for a Signature Session, this number may fluctuate. MINI SESSIONS: The client shall remit a $350 session fee to reserve the date of services for the portrait session. The session fee includes photographer time and talent plus the choice of 5 full resolution images of your choice. Additional images can be purchased at a rate of $75 each. Should you decide you want the full gallery of images the rate is a flat $500 fee. Your 5 choices will be sent via digital download in both black and white and color. Life in Motion will present an average of 15 proofs for a Mini Session, this number may fluctuate. Prices for digital files and products are valid for a period of 14 days after the date of your session. MODEL CALL SESSIONS: Life in Motion will occasionally offer model call sessions to obtain specific shots or locations for marketing purposes. While there is no charge for a model call session, the location or type of session may be restricted. You will receive a full gallery download in exchange for a full marketing release below including images for print, online ads, blog posts, instagram and facebook. You must be willing to be tagged and share your favorite images to qualify for this type of session. Due to the large number of images produced by Life in Motion Photography each year, your images will be kept on file for 30 days and then archived. If there is ever a need for a duplicate disk or retrieval of archived images there will be a $100 fee billed to the client.

Proofing, Copyright & Reproduction *

Average turnaround time to receive proofs is approximately 2 weeks. Images are given individual attention and are corrected for color balance, density, contrast, etc. Life in Motion Photography is granted complete artistic control over the proofing and editing of all images. The photographer will notify the client when proofs are ready for viewing. The client will have 7 days after gallery release to pay the balance due in order to receive the gallery download. Life in Motion Photography takes great care in editing each individual image and the quality is important; scanning or altering an image depreciates its value and along with it, the photographer’s reputation. All work, product and proofs captured from a session are copyrighted and protected under intellectual property rights held exclusively by Lyndsay Stradtner and Life in Motion Photography. While all packages include full resolution digital images, copyright is maintained by Lyndsay Stradtner and Life in Motion Photography. A limited release will be provided to the client for printing purposes. Images can be shared online, including facebook, blogs, etc. with proper credit given and a link to www.lifeinmotionphotography.com. Images cannot be used for commercial purposes or submitted to contests, casting calls or used in another other matter without written permission. Reproduction, alteration or scanning of any proof without written release is a violation of copyright laws.

Release of Liability & Severability *

If the client is not satisfied with the images or products through negligence or fault of Life in Motion Photography, the photographer has the discretion to retake the images or provide a partial/full refund. Notification of dissatisfaction must be provided by the client in writing within one week of receipt of images or upon receipt of products in order to qualify for replacement or refund. Life in Motion Photography will do everything necessary and feasible to ensure the satisfaction of the images and products. Life in Motion Photography will not be responsible or liable for dissatisfaction due to circumstances beyond the photographer’s control. Life in Motion Photography reserves the right to refuse a requested location for any reason. In the event that photographic materials are damaged or lost through camera or computer malfunction, Life in Motion Photography shall take reasonable measures to retake the session whenever possible or provide a refund of the cost of the session if the images cannot be retaken. Upon refund of a session fee or termination of this agreement, Life in Motion Photography is released of all obligation, responsibility, and liability to the client. The client understands that the style of photography produced will be similar to the style, artistic creativity, and caliber displayed on the Life in Motion Photography website, weblog and promotional materials. It shall be the responsibility of the client to ensure the safety of those being photographed at all times. Please keep an eye on your child/children at all times and be sure to discuss any concerns relating to developmental abilities of small children before or during the session. The safety of those being photographed is always a top priority. It is the responsibility of the client to inform all subjects involved in the session of the terms of this agreement. Should any of the clauses, sentences, paragraphs, sections or parts of this agreement be deemed invalid, or unenforceable by a court of law with jurisdiction over the matter, such action shall not be construed to affect any other valid portion of this agreement.

Model Release

The client grants that Life in Motion Photography may use any images taken at the portrait session for the purpose of its business and services; including but not limited to: website, weblog, studio display, promotional materials, photo exhibits, mentoring packages and product demos. The right to edit and approve for public use is granted to the client.
